"All agreements, explicit or implicit alliances, or directives intended to influence the formation of prices, either by raising or lowering them, are prohibited, in any form whatsoever, including through the joint fixing of wholesale or retail prices, the exchange of information or coordination regarding the level and proportion of their increase or decrease or through the determination of the level of the applicable profit margin, the composition of prices, the setting of a reference price or a unified reference price structure between a group of players, or the practice of clandestine storage, at their initiative or under the control of their professional association or trade union", says the Competition Council in a statement.
In this context, the Competition Council refers for any useful purpose, to its practical guide relating to the adoption of compliance programs within companies or professional associations, which details the prohibited practices and the means to avoid the risks associated with them, knowing that this guide can be downloaded on the website of the Council.
The Council also notes that the commission of the aforementioned acts and practices, if proven, regardless of their cause or context, constitutes a violation of the provisions of the aforementioned law.
